Welcome to Overwatch Counseling (“Overwatch,” “we,” “us,” or “our”). These Terms of Service (“Terms”) govern your use of our website, online content, and any services accessed through this site (collectively, the “Site”).

By using this Site, you agree to these Terms. If you do not agree, please do not use the Site.

Important: Information on this Site is for educational and informational purposes only. It does not create a counseling relationship and is not a substitute for professional mental health or medical care.

1. Not Emergency or Crisis Services

Overwatch Counseling does not provide emergency or crisis services through this Site.

If you are experiencing a life-threatening emergency or are in immediate danger:

  • Call 911 or your local emergency number

  • Go to the nearest emergency room

  • Contact a crisis hotline such as the 988 Suicide & Crisis Lifeline (in the U.S. dial 988)

Do not use this Site, email, or any contact forms for crisis situations.

2. No Online Therapy Relationship Created By This Site

Using this Site, sending an email, or completing a contact form does not create a therapist–client relationship with Overwatch Counseling or with Will Kimmins.

A formal counseling relationship is only established when:

  1. You and the clinician mutually agree to work together;

  2. All required informed consent and intake documents are completed and signed; and

  3. An appointment is scheduled and confirmed.

Until then, any communication should be considered informational only.

3. Eligibility to Use This Site

You may use this Site only if you:

  • Are at least 18 years old; or

  • Are using the Site with the knowledge and consent of a parent or legal guardian; and

  • Are legally able to enter into these Terms under the laws of your jurisdiction.

4. Informational and Educational Content

Any articles, blog posts, resources, videos, or other content on this Site are for general informational and educational purposes only.

They:

  • Are not individualized mental health advice;

  • Do not diagnose or treat any condition;

  • Are not a substitute for counseling, psychotherapy, or medical care.

Do not disregard professional advice or delay seeking it because of something you read on this Site.

5. Scheduling, Fees, and Payment

Information about current rates and session types is provided on the “Rates & Fees” section of the Site and may be updated from time to time.

  • Fees and session lengths are clearly listed so you can review them before booking.

  • Payment is typically due at the time of service, unless otherwise agreed in writing.

  • Overwatch Counseling reserves the right to adjust rates in the future with reasonable notice.

Any policies regarding cancellations, late fees, missed appointments, or insurance (if applicable) will be explained in the informed consent documents you receive as a client and may not be fully detailed on this Site.

6. Telehealth Services

If telehealth services are offered, they will be provided in accordance with:

  • The laws and regulations of the state(s) where the clinician is licensed; and

  • The location of the client at the time of service.

Telehealth has limitations, including technology issues and privacy concerns in your physical environment. These limitations and risks are discussed in separate telehealth consent documents when you become a client.

7. Intellectual Property

All content on this Site—including text, graphics, logos, images, and layout—is owned by or licensed to Overwatch Counseling, unless otherwise noted.

You agree that you will:

  • Not copy, reproduce, distribute, republish, or create derivative works from the Site content without our prior written permission;

  • Not remove any copyright, trademark, or proprietary notices.

You may, however, share links to publicly available pages of this Site for personal, educational, or non-commercial purposes, provided you do not misrepresent our content.

8. User Conduct

When using this Site, you agree that you will not:

  • Use the Site for any unlawful purpose;

  • Attempt to gain unauthorized access to any systems, data, or accounts;

  • Upload, transmit, or share any harmful, threatening, harassing, defamatory, or otherwise inappropriate content;

  • Interfere with or disrupt the operation of the Site.

We reserve the right to limit or terminate your access to the Site if we believe you have violated these Terms.

12. Professional Relationship Disclaimer

Nothing in these Terms or on this Site:

  • Creates a therapist–client relationship;

  • Creates a coaching, consulting, or supervisory relationship; or

  • Guarantees acceptance as a client.

Any professional relationship is governed by separate written agreements and informed consent documents.

13. Governing Law

These Terms are governed by the laws of the state in which Overwatch Counseling is legally registered and operates, without regard to its conflict of law principles.

14. Changes to These Terms

We may update these Terms from time to time. When we do, we will revise the “Last Updated” date at the top.

Your continued use of the Site after changes are posted means you accept the revised Terms.
